Terms of service
1.1. These terms of service regulate the legal relationship arising between Salesman OÜ, registry code 11590186, Sinilille tee 6, Peetri, Harjumaa (seller) and the person who made the purchase (customer) in the purchase-sale of the products and accessories at www.facewear.eu e-store
1.2. In addition to these conditions the legal relationships arising from the distribution of products via the e-store are regulated by the laws of the Republic of Estonia.
1.3. The Trader may change the terms of the e-store and the prices of the products and services. Changes will be notified in the e-store’s environment. The terms and prices applicable at the time of the transaction taking place are applied to the transaction.
1.4. The selection of products, prices and discounts may differ from the product selection, prices and discounts of the Trader’s retail product selection.
2.1. The prices of the products are provided on the products’ sheet and the prices include the 20% value added tax in force in Estonia.
2.2. The delivery fee in accordance with the delivery method chosen by the Customer in the course of formalising the order is added to the price of the products. The manner of delivery will be chosen and the delivery charge calculated in the basket.
2.3. In case of the existence of a discount code the discount of the product will be calculated after entering the discount code in the basket.
3. COMPLETING THE ORDER
3.1. The Client will add the product to the basket after choosing the product and, where necessary, the size on the product sheet by clicking the “Add to cart” button.
3.2. The quantities in the basket may be changed and products may be removed from the basket until paying for the products.
3.3. For completing the order the necessary details need to be entered, the payment method chosen and the button “Place order” clicked in the basket.
3.4. The order is deemed to be conclusively completed after clicking the “Place order” button.
3.5. The Seller will send a notification for the confirmation of the order to the Customer’s email address.
3.6. In case of not having the Product ordered by the Customer the Seller will cancel the order. An order may be cancelled in part as well as in whole. The Customer will be informed of a cancelled order immediately. In case of a partial cancellation the Seller may ask for the Customer’s wishes for handling the rest of the order – whether to dispatch or cancel as well.
4.1. The Customer will pay for the purchases made in the Web environment (e-store) 100% in advance.
4.2. The orders can be paid for by credit card (Visa, MasterCard), Estonian bank links (Swedbank, SEB, Nordea, LHV Pank), Latvian bank links (Swedbank, SEB), PayPal environment and Stripe.com payment system.
4.3. Payment takes place in a secure environment outside the e-store – when paying with a bank link in the secure environment of the respective bank, when paying by credit card in the secure environment of Maksekeskus AS (http://maksekeskus.ee/),in case of PayPal payments in the PayPal secure environment respectively, and in case of Stripe.com credit card payments in the Stripe secure environment respectively. The Trader does not have access to the Customer’s bank and credit card details.
4.4 Salesman OU is the controller of personal data, Salesman OU transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS.
4.5. After placing the order and making the payment the Customer will be sent a confirmation via email, on delivery an invoice is added to the parcel.
5. DELIVERY OF THE PRODUCTS TO THE CUSTOMER
5.1. The e-store delivers products to mostly all countries in the World.
5.2. The products are delivered to the Customer as the Registered Package service offered by Omniva (AS Eesti Post), DPD, UPS courier service, Standard post or similar shipping services.
5.3. The Customer will pay for the costs arising from the delivery of the Products, depending on the destination and method of shipping.
5.4. The Seller will complete the orders, incl. hand over to the post office or courier for dispatch within three till seven working days from the confirmation of the order at the latest. The arrival of the product to the Client depends on the postal service.

When ordering products from our e-store you can choose from the following delivery options:
For the parcels shipped outside of European Union: customs and import duties may apply when receiving goods. These duties are paid by the receiver of the parcel. As the tax and customs policy may vary in different countries, we recommend you to contact the local customs or tax board’s representation for additional information. Order is completed and posted within 3-7 working days. The arrival of the product depends on the postal service. Please note, that during holidays delivery times may be longer than normal. We hope for your understanding.
6. RIGHT OF WITHDRAWAL, RETURNING AND EXCHANGING GOODS
Return Goods Policy
Purchased from our e-store products can be returned within 14 days from receiving if that product returnable (Facemask is not returnable product, because it is part of hygiene product), without disclosing the reason. In this case, within 14 days from receiving your order, you have to send returned items back to us and send an a request to the email: firstname.lastname@example.org with the following information:
1. Your order number
2. Name of the item you want to return
3. Copy (photo) of the receipt from the post office or other shipping company proving that you have shipped goods you want to return, back to us.
We will refund a value of returned goods to you within 14 days from receiving parcel back to us. Shipping costs are not refundable. We will return the money to the same account from which money was received.
Only completely unused product, which has all the labels and other documents and the invoice that came with the parcel, can be returned. In case you want the product to be exchanged or replaced you should write us the products to be exchanged, replaced or mended and in case of an exchange also the sizes wanted. Until receipt of the parcel Facewear cannot take liability for the products. We recommend you to retain the document received at post office to prove the posting later. Please use registered post.
Returning the wrong or poor-quality product
In case the product is defective, let us know about it immediately or not later than within 1 week of finding out about the defectiveness. Send the respective information to the email email@example.com noting your contact details, the date of making the purchase, the description of the defect of the product and the claim submitted to us.
We do our best to keep FACEWEAR products quality on the top level. But In case you get poor-quality product, please return it to us. Also please send us an email with your purchase invoice number, name of the product with poor quality, and details about poor quality part in the product. We will return to you both the value of the product and dispatch costs, incl. costs incurred when posting the return. To do that, we ask you to retain the document received at posting and send it to us on the firstname.lastname@example.org together with the order number.
Exchanging the product
In case the size of the received product did not suit you and you want to exchange the product, you can do it within 14 days of receiving the order. A product can only be exchanged for a different size of the same product. If we are unable to find the requested size for the product returned for exchange we will notify you about it via email. NB! Facemask is hygiene product and cannot be exchanged or returned if package was opened. Also other products with discount are not refundable or exchangeable.

Returning the money
In case of withdrawal from a contract we will return to you the sums paid, incl. the cost of delivering the product to you, within 14 days after receiving returned product to our facility.
7. SUBMITTING A COMPLAINT
7.1. The Seller is responsible for the nonconformity to requirements and defects of the products for 1 week from the receipt of the products by the Customer.
7.2. On discovering the nonconformity to requirements of the product or defects of the product the Customer undertakes to notify the Seller immediately but no later than within 1 week from becoming aware of the nonconformity by sending the respective information to the email address email@example.com or in writing to the address of Salesman OÜ, Sinilille tee 6, Peetri, Harjumaa
7.3. In case of a nonconforming or defective product the Customer has the right to claim the performance of obligations from the Seller, withdraw from the contract or to cancel the contract and claim compensation for damages, reduction of price, in case of delaying the fulfilment of financial obligations claim a fine.
7.4. In case of nonconformity of the product to requirements or defects the Customer has the right to first demand the free mending of the product or replacement with a product conforming to the requirements and without defects or to return the product at the Seller’s expense.
The Customer has the right to demand the reduction of the purchase price of the product or the termination of the contract and the recovery of the sums paid for the product if:
- The Seller is not able to mend or replace the product or
- Mending or replacing the product fails or
- The Seller has not rectified the defect of the product within a reasonable time or
- The Customer is caused unjustifiable inconveniences.
7.5. In case of returning a nonconforming product the Customer will be compensated for the sums paid for the product together with transport costs to the same account from which payment was received. The Seller has the right to delay returning the sums paid until the Customer has returned the product in his possession or submitted evidence of handing over the product to the post office for returning.
7.6. The Seller is not liable for or will compensate the Customer for expenses made in case of nonconformity of the product to the requirements or defects if:
7.6.1. The Product has deteriorated/been damaged due to the fault of the Customer;
7.6.2. Defects have been caused by the use for a non-intended purpose, incl. as a result of not following the care instructions;
7.6.3. The Product has changed due to normal wear of ordinary use.
7.6.4. The document proving the making of the purchase is missing.
7.7. In case disputes have arisen between the Customer and Seller on the defects of the product, the Customer has the right to turn to the Seller with a complaint, by specifying in a complaint submitted in writing or in a form allowing for written reproduction (email) his name and contact details, the date of submitting the complaint, the defect existing in the product and the solution requested by him. The Seller will respond to the Customert’s complaint in writing or form allowing for written reproduction (email) within 15 days.
7.8. In case the Customer and Seller do not reach an agreement on the dispute and the value of the product in dispute is at least 30 euros, the Customer has the right to turn to the consumer claims commission operating with the Consumer Protection board for an extrajudicial settlement of the dispute. The review of the complaint in the consumer claims commission is free for the parties. The disputes are solved by reference to the laws of the Republic of Estonia.
7.9. On not agreeing with the decision of the commission the parties have the right to turn to the local county court of the Trader.
8. PROCESSING PERSONAL DATA
8.1. The data about the Customer and his order stored in the orders’ environment of the e-store are treated as confidential information. The Seller will not disclose the information that has become known to it to third parties.
8.2. The data communication between the Customer and banks and card payment centres is encrypted, which ensures the security of the Customer’s personal data and bank details. The Seller does not have access to the Customer’s confidential bank and payment card details.
8.3. The personal data submitted by the Customer, which the Seller has received on making the purchase by the Client are protected and they are processed according to the requirements of the Personal Data Protection Act.
Personal data is collected and they are processed for the following purposes: for making purchase analyses and summaries, for making offers to the Costumer but also for organising Customer satisfaction questionnaires.
8.4. The customer may unsubscribe from receiving offers and newsletters by e-mail at any time by notifying us thereof by e-mail or following the instructions provided in the e-mail with offers.
8.5. The personal data of the Client is processed by Salesman OÜ, registry code 11590186, Sinilille tee 6, Peetri, Harjumaa
8.6. Salesman OÜ may authorise other legal persons (authorised processor) to process personal data on the condition that a contract has been entered into with such a processor, according to which the authorised processor is obligated to keep the personal data to be processed as confidential and to ensure the relevant protection of personal data according to the requirements provided in the legislation.
8.7. Customer is entitled at any moment to enforce his/her rights. The right to obtain confirmation that user’s personal data exist or do not exist, verify their content, origin and accuracy, ask for their integration, updating, amendment, deletion, transformation in anonymous form, block for breach of laws and regulations, and user may oppose for legitimate reason the data processing.

Salesman OÜ is not using the details of our customers for illegal purposes. Salesman OÜ is not disclosing the details or personal data of our customers to third parties, unless disclosure of such information is compulsory and compliant with the legislation of the Republic of Estonia. All customer details (personal data and payment information) are inaccessible by third parties. Facewear.eu respects the privacy and confidentiality of the personal data of our customers. All customer details are protected by the data protection legislation of Estonia.
- PROCESSED DATA
1.1. Facewear.eu may collect and receive Customer Data in various ways. When you visit or use the Websites or Services, we collect and process different types of information about you (Customer Data):
- Identity Data includes first and last name, user ID.
- Contact information includes billing address, shipments address, email address, homepage, social media identifiers, fax or phone number. Such information may also include contact persons and representative data.
- Professional Information about company information, workplace location, and other administrative and sales information and goals.
- Financial information includes bank, bank account, payer, deadlines, sanctions and credit details.
- Transaction Data contains details of payments and sales documents and other details of the products and services you have purchased from us.
- Marketing and Communication Data includes your desires for advertising and communication with us and third parties.
2.1. Customers leaving their contact details (name, telephone, e-mail address, postal address, etc.) at the disposal of Salesman OÜ enable us to fulfil the customers’ wishes and, in the case of any issues, settle them together.
2.2. Salesman OÜ uses your Personal Information to:

- Communicating with you, responding to your demands, comments and questions. If you contact us, we can offer you use Other Information to reply.
- Develop and provide additional features.
- Email and other communications. We may send you the Service, technical and other administrative emails, messages, and more information. 4.1. Salesman OÜ news are only emailed to the customers who have subscribed to the mailing list. Customers who are no longer interested in receiving news from us may unsubscribe at any time. Our customers’ email addresses and telephone numbers are not disclosed to third parties.
- TRANSMISSION OF PERSONAL DATA
5.1. Salesman OU is the controller of personal data, Salesman OU transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS.
5.2. Personal information is passed to online store customer support to manage purchases and purchase history, and to resolve customer issues.
5.3. Personal data will be transferred to the accounting service provider for accounting purposes.
5.4. Personal information may be transferred to information technology service providers where necessary to ensure web store functionality or data hosting.
- ACCESS, CORRECTION, TRANSFER AND DELETION OF PERSONAL DATA
6.1. Unless otherwise provided by law, the Customer shall have the right at any time to inspect his / her personal data and to request the modification or deletion of such data. Personal information can be accessed and corrections made to the online store user profile. If the purchase is made without a user account, personal information can be accessed through Clint Support.
6.2. To delete your personal information, please contact customer support at firstname.lastname@example.org. The request for erasure shall be replied to within not more than one month and the period for erasure shall be specified.
6.3. The customer has a right at any time to demand that their details will be transferred to different media by writing digitally signed statement to email@example.com. Salesman OÜ has a right to decline if they feel it is not safe to transfer details to third-party.
- RETENTION OF DATA
7.1. Closing an online store customer account will delete personal information unless it is necessary to maintain such data for accounting or consumer dispute resolution purposes.
7.2. If a purchase is made without a client account in the online store, the purchase history is kept for three years.
7.3. In the case of disputes concerning payments and consumer disputes, personal data shall be retained until the claim has been complied with or until the limitation period has expired.
7.4. The personal data necessary for accounting purposes shall be kept for seven years.
- SECURITY AND ACCESS TO DATA
8.1. Personal data is stored on the servers of Shopyfy.com located in United States.
8.2. Access to personal information is available to online store staff, who can access personal information to resolve technical issues related to the use of the online store and to provide customer support.
8.3. Salesman OÜ implements appropriate physical, organizational and IT security measures to protect personal information from accidental or unlawful destruction, loss, alteration or unauthorized access and disclosure. 8.4. The transfer of personal data to authorized processors of Salesman OÜ (eg, data hosting of a transport service provider) is subject to agreements with the web store and the authorized processors. Controllers are obliged to provide appropriate safeguards for the processing of personal data.
- SETTLEMENT OF DISPUTES
9.1. If the customer feels Salesman OÜ has been violating their right processing personal details, they have right to turn to Guidelines on Data Protection Officers and court.
